I have had a bailiff call at 18 30 pm while I was at work..My daughter took the paper work through the letter box. It is for council tax arrears and I wish to offer them a weekly payment of £25.00. What are the times that they can call. I was told it had to be after dawn and before dusk. If this is the case do I have a right to complain and how should I address them to negotiate payment without them entering my home.

Your daughter was not able to accept service of these papers by the bailiff. His visit counts for nothing legally although I am afraid that they will try to make a charge for what was in effect an abortive call. I am afraid that with private baillifs as these will have been, an evening calls is permissible.

The legislation relating to Council tax is very harsh and unlike any other type of debt, the court does not have power to allow payment by instalments. A liability order will have been made and this gives almost absolute power to the baillifs. I do not think you need worry however as I am sure that your offer be accepted
