Assignment of Tenancy Agreement

An Agreement whereby the rights and obligations of a Tenancy Agreement are assigned to another.


Where an existing tenant or tenants wishes to leave the property prior to the date of termination of an Assured Shorthold Tenancy Agreement, and providing that the shorthold agreement allows for an assignment, this agreement can be used to assign the tenancy to a replacement tenant or tenants. Note that under the tenancy agreement the landlord's consent is usually required for an assignment.

The agreement recites :

• The names and details of the ingoing and outgoing tenants
• The agreement of the landlord to the assignment
• The agreement of the incoming tenants to indemnify the outgoing tenants in respect of any claim
• The agreement of the incoming tenants to comply with the terms of the tenancy
